Fresh off the course at the Humana Challenge golf tournament this weekend, Phil Mickelson told reporters that recent tax hikes on the rich might force him to make "drastic changes," suggesting he'd be leaving either golf or his home in California.
At the center of Mickelson's tax complaint was his claim that he pays a tax rate of 62 to 63 percent.
"If you add up all the federal and you look at the disability and the unemployment and the Social Security and the state, my tax rate's 62, 63 percent," Mickelson said. "So I've got to make some decisions on what I'm going to do."
Related:?Did California's Rich Tax Really Shrink Its Deficit?
There is no doubt that Mickelson's taxes are high. And they just went up by an additional 7.9 percent over the past three months due to the "fiscal cliff" deal and California's Proposition 30.
But several accountants interviewed said it's unlikely that Mickelson is actually paying a rate above 60 percent. With even the most basic tax planning, they said, his real rate is most likely closer to 50 percent.
After his comments turned into a rare off-course controversy for Mickelson, he apologized but didn't back away from his numbers. "Finances and taxes are a personal matter and I should not have made my opinions on them public," he said today in a statement. "I apologize to those I have upset or insulted and assure you I intend to not let it happen again."
But let's consider those numbers.
Under current tax rates, Mickelson would pay 13.3 percent in state income tax and 39.6 percent in federal income tax. That's 52.9 percent combined. Medicare and Medicaid is an additional 2 percent. The new health-care levy is .9 percent on earned income and 3.8 percent on investment income.
Self-employment taxes could total an additional 15.3 percent -- but that's only on income up to $113,000, accountants say. After that the rate is 2.9 percent.
Mickelson would also pay local taxes where he plays tournaments. That could add another one percent or two percent.
So the maximum Mickelson could pay in state and income taxes, payroll and other income-related taxes would be around 60 percent.
But that rate is only if he did absolutely no tax planning or basic deductions. He would, for instance, get a deduction on his state income taxes from his federal. He would also deduct any golf-related expenses as a business expense. He probably puts money in a retirement plan, which is tax-favorable.
I would guess that Mickelson has some investments, which would be taxed at the lower capital gains rate of 20 percent (or 23.8 percent with the new health-care tax). And I would guess he might have a mortgage deduction, or other deductions related to kids and education.
And we know that Mickelson gives money to charity. So that would be deducted as well. If he has trusts (which he likely does) that also reduces his tax rate.

Steven Piascik, president of Piascik ? the accounting firm that works with dozens of professional athletes ? said that he easily could bring Mickelson's rate to around 50 to 52 percent with some "basic tax planning."
"I couldn't guarantee it, but 8 to 10 percent off that 62 percent rate seems normal," he said. "I would guess he's doing a lot of these things already."
Either Mickelson misspoke ? or he needs to hire a new accountant.

Smoke rises over a fence of a prison camp where jailed feminist punk band Pussy Riot member Maria Alekhina, unseen, serves her term, in the town of Berezniki, some 1500 km (940 miles) north-east of Moscow, Russia, on Wednesday, Jan. 16, 2013. MOSCOW (AP) ? The imprisoned members of the Pussy Riot feminist punk band say they feel no regrets about the irreverent "punk prayer" against President Vladimir Putin in Moscow's main cathedral that landed them behind bars for two years.
Nadezhda Tolokonnikova and Maria Alekhina offered a vivid, but stoic, description of their harsh prison conditions in interviews published Wednesday in the independent Novaya Gazeta newspaper. They said they don't expect clemency from authorities.
Tolokonnikova, who works at a sewing machine like most female prisoners in Russia's prison colonies, was quoted by the paper as saying she has had her fingers punctured by the needle but has picked up speed and experience and can now meet her quota of making lining for 320 jackets a day.
Like other prisoners, she bathes once a week and uses cold water to wash the rest of the week.
"I am not paying much attention to living conditions," she said in an interview filmed last month. "I'm ascetic, and living conditions matter little for me."
Tolokonnikova said she meditates to prevent her spirit from being dulled by the monotonous labor. She added that the main thing she misses at her prison colony is the ability to read freely; prison conditions leave little room for reading the Bible and philosophy books.
Three members of Pussy Riot were found guilty of hooliganism motivated by religious hatred in August after they raucously prayed to the Virgin Mary for the deliverance from Putin at Christ the Savior Cathedral. One of them, Yekaterina Samutsevich, was later released on appeal, but Tolokonnikova and Alekhina were sent to prison colonies last fall.
Tolokonnikova argued that their protest wasn't aimed at religion. "It was an ironic, cheerful and bold act, a political outcry, so to speak," she said, adding that the Russian state media interpretation of it as a blasphemous action was deliberately wrong.
She said she wants to go to a prison church to talk to its priest and attend the service, although she added she has no intention of being baptized just yet.
She said that she had been warned about likely harassment by other prisoners who felt insulted by the band's act, but there was nothing like that at her prison colony in Mordovia, a province in western Russia about 350 kilometers (217 miles) southeast of Moscow.
"They never asked whether I'm religious or anti-religious," she said.
Tolokonnikova said that she has grown tired of the stunt in the cathedral that made the band members global celebrities and drawn protests around the world against Russia's intolerance of dissent. "It's just impossible to think about your work for so long, you would want to switch to other works and forget about the previous one," she said.
Asked whether she wants to say something to Putin, she answered bluntly: "No, honestly speaking, for me he doesn't exist. He is just a blank spot for me."
Earlier this month, Alekhina, who is serving her sentence at another prison colony in the Ural Mountains Perm region, had an appeal rejected by a local court.
Alekhina, who is serving her sentence in a different colony, complained of systematic violation of human rights by the prison administration. She said she was transferred into a solitary cell for 90 days in November after receiving threats from fellow inmates that she suspects were instigated by prison authorities.
"They told me that I would be done with if I stay in that unit," she said.
She said she doesn't mind a solitary cell because it offers good condition for reading, unlike the crowded barracks where it's hard to concentrate.
Alekhina, a vegetarian, said she was cooking her own food from fresh products provided by supporters.
"I will survive, nothing will happen to me," she said, adding that if she faces any pressure she would go on a hunger strike and then be sent back to a solitary cell.

The long-rumored Steam?Box game machine from much-loved gaming company Valve has become more of a reality at this week's Consumer Electronics Show in Las Vegas.
Valve hasn't actually shown off any new?hardware and has?only a small presence at the show. However, the company behind the online PC?games distribution platform known as?Steam (not to mention hit games such as "Portal" and "Half-Life")?has stirred up a lot of?excitement among game enthusiasts by making it clear it has?big plans for living room play.
In an?interview with The Verge,?Valve?s co-founder Gabe Newell confirmed that the company is working on its own?gaming hardware for the living room???hardware that's specially?designed to leverage its hugely popular?Steam distribution service to deliver PC?games and other media directly to your HDTV and perhaps?other screens in the house.
This is big news, especially considering that Steam boasts some?50 million users worldwide???many of whom would probably love to have?a convenient,?comfortable?way to play their favorite Steam-delivered PC games on their living room TV.
So what will this so-called?Steam Box look and operate?like, exactly? Newell and Valve haven't released much in the way of exact details. But?the Valve head honcho?did say?the box would be based on the Linux operating system???perhaps not a?surprise since?Newell has a now-notorious dislike?of Windows 8.
"We?ll come out with our own?and we?ll sell it to consumers by ourselves," Newell said of their hardware, adding, "That'll be a Linux box,?[and] if you want to install Windows you can. We?re not going to make it hard. This is not some locked box by any stretch of the imagination. We also think that a controller that has higher precision and lower latency is another interesting thing to have.
Newell said the smart minds at Valve have been attempting to improve upon the standard?game controls in some interesting ways.
"I think you'll see controllers coming from us that?use a lot of biometric data," he told The Verge. "Biometrics ...?is essentially adding more communication bandwidth between the game and the person playing it, especially in ways the player isn?t necessarily conscious of. Biometrics gives us more visibility. Also, gaze tracking. We think gaze tracking is going to turn out to be super important."
As far as other details go,?Newell mentioned that the company is looking at?making the so-called Steam Box?capable of?delivering games to up to eight different screens in the house simultaneously.
"So you could have one PC and eight televisions and eight controllers and everybody getting great performance out of it," he said.?"We?re used to having one monitor, or two monitors ? now we?re saying let's expand that a little bit."
But perhaps the best glimpse of what an official Steam Box might look something?like is from PC-maker Xi3.?Valve has invested in?the company , which?revealed its?new modular Piston computer.?The Piston, pictured above, is the size of a grapefruit and?still in the development stage.?The cube-shaped PC that has been optimized to play games on HDTVs?using Valve's Steam service and its?new Big Picture Mode.?
Remember,?Valve has already taken its first steps toward delivering?PC?games to home HDTV's with the?newly launched Big Picture Mode.?Big Picture is designed to simplify the process of getting PC games onto the TV by?redesigning?the Steam interface specially for use on?a?TV screen?and by?highlighting PC games that can be played using a standard button/thumbstick-sporting game controller.
But?Valve representative Tom Giardito told PC Magazine?that, in fact,?Xi3 is just?one of many hardware partners working with Valve. He said?Valve attended CES this year primarily to meet with manufacturers and?explore how a Steam Box-type?interface or standard could?be set up across many devices. Furthermore, he said?that Steam Boxes???whatever shape they take???won't be available until after a?lengthy testing.
With Sony and Microsoft expected (thought not confirmed) to reveal their next home game machines sometime this year, it will certainly be interesting to see if Valve times the arrival of?its own hardware to compete.
Then again, the folks at?Valve are?known for doing things their own way in their own time. So while all the Steam Box talk is exciting ... gamers should prepare for?more waiting and wondering ahead.

Cox Communications continued to build on its investment in live TV streaming, unveiling its latest mobile app at a CES presser. Developed in partnership with Cisco, the yet unnamed app will feature 90 live channels, On Demand content and personalized video recommendations for up to eight household members. Folks who don't quite feel the recommendations they receive will also be able to "like," "dislike" or "suspend" them. Cox apparently plans to place its proverbial eggs into this one basket, eventually integrating all its mobile applications into the app. Cox has been busy releasing all sorts of digital offerings in the last few years, including the Cox TV Connect app in late 2011 as well as its Cox Mobile Connect apps. The new app is slated to debut on the iPad first but will be available on more devices by the end of the year. For more details, check out the PR after the break.
